NeverStop Program Terms

The following terms and conditions (the “Terms”) govern your participation in NeverStop, including without limitation the accrual of Sparks based on your completion of actions offered through NeverStop. For purposes of these Terms, “You” or “Your” refers to the Member, and “Assured,” “we,” or “us” refers to Assured, Inc.

A. Overview


NeverStop offers actions across our five aging well domains: Body & Movement, Mind & Memory, Emotional Health, Connection, and Life Navigation. You will select actions based on your interests and goals, and may update your selections at any time. As you complete actions, you may earn Sparks. Sparks may convert into credits, increased coverage, or other financial rewards or benefits. Conversion is determined by your Carrier and is not guaranteed.


B. Incorporated Documents


Our Terms of Service, Privacy Policy, and Consumer Health Data Privacy Policy are incorporated herein by reference and apply to NeverStop, including without limitation the disclaimers, limitations of liability, and all other provisions.


C. Enrollment


Concurrent with the issuance to you of an insurance contract by your insurance carrier (the “Carrier”), you will (a) receive an email containing a link for enrollment in NeverStop, and (b) the Carrier will charge you its annual membership fee to cover your participation in NeverStop. 

Upon receipt of our enrollment email, please click on the link and proceed with the NeverStop enrollment process, which includes: (i) providing us or otherwise confirming various personal data and contact information about yourself, including without limitation specific health data, (ii) establishing a NeverStop account, (iii) learning about the Sparks system and how Sparks may contribute to your benefits, (iv) completing a brief assessment and selecting an area of interest, and (v) selecting initial actions you'd like to complete as part of NeverStop. We may contact you in order to remind you about your enrollment until you've successfully enrolled. In addition, you will have access to coaches who can provide personalized guidance and support throughout your participation in NeverStop. Coaches can be contacted by booking an appointment through the member site, sending an email, or calling the toll-free phone number listed in Section I below.


You are responsible for notifying us of any changes to your contact details and health information. You may use the email or phone number listed in Section I to contact us.


D. Membership Fees and Refunds


We will neither charge nor invoice you for any fees related to your membership in NeverStop, as all fees shall only be invoiced by, and paid directly to, your Carrier. Similarly, any refund you may be entitled to receive due to the cancellation of your participation in NeverStop shall be subject to your Carrier's refund policies and will only be issued by the Carrier.


E. Cancellation


Participation in NeverStop is not mandatory, but you are required to actively cancel your NeverStop membership if you do not wish to participate. You may cancel solely by contacting your Carrier. If you do not cancel your NeverStop membership, your Carrier will charge the membership fee to you annually. As noted in Section D above, refunds will be solely processed by your Carrier, subject to the Carrier's applicable refund policy, and not by us.

If you cancel your NeverStop membership for any reason and at any time, (i) all of your accrued Sparks through such date will be immediately forfeited and unrecoverable, and (ii) you will not be permitted to re-enroll within NeverStop once you’ve canceled your membership.


F. Sparks and Rewards


As you complete various actions from among those that you've selected during the course of your membership, you may earn Sparks. As described above, Sparks may convert into credits, increased coverage, or other financial rewards or benefits, as determined by your Carrier. Please refer to the coverage materials supplied by your Carrier for the details pertaining to Sparks and associated benefits. Any questions you may have regarding the application of Sparks and/or associated benefits should be raised directly with your Carrier. You acknowledge the values ascribed to Sparks earned from completing actions are determined solely by your Carrier and may change from time to time.


We have sole discretion with respect to the administration and enforcement of these Terms, which we may modify from time to time in our sole discretion.


Your Sparks are not transferable and may not be combined with any other rewards or with any other Member's credits.


The Sparks are meant to reward you for your participation and involvement in NeverStop. If we determine in our discretion that you were improperly awarded Sparks for any reason, we reserve the right to deny, revoke, or cancel such rewards. If, on the other hand, you believe that you have earned but not received Sparks, you should submit a request to us by email to the email address listed below. We may require you to submit documentation or other proof satisfactory to us to substantiate your claim. Please allow 30 days from the date of your email for us to review your submission and either render a decision or request additional information.


While we have the final decision on all matters pertaining to your membership in NeverStop, your Carrier has the final decision on all matters pertaining to the application of your Sparks and any other terms associated therewith. In the event of a dispute over such matters, you will be required to submit such dispute directly to your Carrier. 


G. Communications


By participating in NeverStop, you authorize us to send you electronic communications, some of which may be considered commercial advertising or promotional in nature. You may always opt-out of receiving marketing communications by (i) clicking on the unsubscribe link located in the footer of each email message, (ii) replying “STOP” (or another message we may designate) to any SMS that we send you, (iii) updating your communication preferences on the member site, (iv) telling your coach you'd like to opt out, (v) writing to us at the email address listed in Section I below, or (vi) calling us at the number listed in Section I below. Even after you’ve opted out, you will continue to receive certain email communications that are not of an advertising or promotional nature.


H. Data Sharing

You expressly authorize us to share with your Carrier, and likewise for your Carrier to share with us, your personal information, including without limitation health and behavioral data in connection with your NeverStop membership. Your authorization is required for your participation in NeverStop and for you to enjoy the benefits thereof. You further acknowledge and authorize us to use your information for administrative and other permissible business purposes consistent with our Privacy Policy and Consumer Health Data Privacy Policy, the latter of which specifically governs the processing of your health and behavioral data.
